Niagara County divorce records are court documents created when a couple starts a divorce case in the New York Supreme Court, the trial-level court that handles divorces. These files help the court trace filed documents, case developments, and case outcomes. In New York, the County Clerk’s Office receives filed divorce papers and maintains the Supreme Court case files.
Given the sensitivity of divorce cases, matrimonial proceedings are confidential under Domestic Relations Law § 235. Consequently, divorce records are not "open like ordinary civil lawsuits," and access may be limited to the parties, attorneys, or someone with a court order, depending on the record requested.
Standard information in a divorce record may include the parties’ names, the index or case number, filing and finalization dates, motion papers, and the final Judgment of Divorce (divorce decree).
